295 C: An Un-Islamic Clause of Pakistan Penal Code

295 C of Pakistan Penal code states:
Use of derogatory remarks, etc; in respect of the Holy Prophet. Whoever by words, either spoken or written or by visible representation, or by any imputation, innuendo, or insinuation, directly or indirectly, defiles the sacred name of the Holy Prophet Mohammed (PBUH) shall be punished with death, or imprisonment for life, and shall also be liable to fine.
Quran does not state any punishment for one who (na’oozu billah) commits tawheen-e-risaalat. There is no Hadith in which the Holy Prophet (Peace be upon him & his family) described death sentence for the one who committed tawheen-e-risaalat.
On the contrary Holy Quran suggests death punishment for three offences only:
1. Murder
O ye who believe! The law of equality is prescribed to you in cases of murder: the free for the free, the slave for the slave, the woman for the woman. But if any remission is made by the brother of the slain, then grant any reasonable demand, and compensate him with handsome gratitude, this is a concession and a Mercy from your Lord. After this whoever exceeds the limits shall be in grave penalty. (2:178)
2. War Against Allah & His Messenger
The punishment of those who wage war against Allah and His Messenger, and strive with might and main for mischief through the land is: execution, or crucifixion, or the cutting off of hands and feet from opposite sides, or exile from the land: that is their disgrace in this world, and a heavy punishment is theirs in the Hereafter. (5:33)
3. Alleging Partners to God
But when the forbidden months are past, then fight and slay the Pagans wherever ye find them, and seize them, beleaguer them, and lie in wait for them in every stratagem (of war); but if they repent, and establish regular prayers and practise regular charity, then open the way for them: for Allah is Oft-forgiving, Most Merciful. (9:5)
Among above-mentioned three categories, only the Messenger (Peace be upon him & his family) of God is authorized to implement the punishment. It is because of the fact that only he can know through wahi that on whom atmaam-e-hujjat has been accomplished. And punishment of death cannot be given in this category without atmaam-e-hujjat.
So a law suggesting death punishment to a person, who committed tawheen-e-risaalat, is un-Islamic.
